Brazil's SPA Launches Public Consultation to Revise Betting Licensing Rules

Brazil's Secretariat of Prizes and Bets (SPA) has initiated a public consultation aimed at gathering input for the revision of regulations governing the licensing process for sports betting and online gaming operators. Published as Public Consultation Notice No. 3/2026, the move seeks to refine the authorization framework based on lessons from the initial licensing cycle.

The consultation, which runs for 45 days from 27 July to 9 September, allows any individual or legal entity to submit contributions via the Brasil Participativo portal using a gov.br account. The SPA plans to use this feedback to draft a decree that will introduce new rules for operating bets in the country, building on the existing SPA/MF Ordinance No. 827/2024.

This review was anticipated in the SPA Regulatory Agenda, established by Ordinance No. 817 in April 2025, which earmarked the first quarter of this year for reassessing the authorization procedure. The regulator will incorporate lessons learned from the first wave of operator authorisations to enhance transparency and efficiency in the process.

The push for greater openness in licensing has been underscored by recent actions from the Ministry of Finance. In June, Finance Minister Dario Durigan announced plans to publish over 25,000 documents related to betting licensing, citing a commitment to transparency. Earlier this week, Administrative Order No. 2,126 created a dedicated task force to ensure transparency in the licensing procedures, reinforcing the government's focus on accountability.
